With PG Environmental support, EPA and the DOJ recently reached a settlement with the BNSF Railway Company over its alleged Oil Pollution Act and Clean Water Act violations in several states. The violations stemmed from four spills of locomotive oil and diesel fuel to U.S. waters, as well as inadequate prevention and response plans at BNSF's rail yards in Colorado, Wyoming, and North Dakota. As part of this work, PG analyzed the flow pathways of the North Dakota spills to assess connectivity with waters of the United States and potential environmental impacts. PG also assessed the adequacy of BNSF Spill Prevention Control and Countermeasure plans and the associated spill containment measures. Under the settlement, BNSF will pay a civil penalty of $600,000. PG Environmental is a wholly-owned subsidiary of ERG.
